Matt's Doing his homework again...

I'm sitting in my usual spot on the third floor of the library passing the time between Civil Procedure and Contracts. This floor is decorated with a painting/drawing/picture of every county courthouse in Tennessee. Each also has a brief history posted below it.This has served to confirm my long held belief that Tennessee has some really beautiful old courthouses. Many of them were built before the civil war. In any case, this got me to thinking, some enterprising soul with the means to travel and a good camera could make a GREAT coffee table book. So go be enterprising. I'm too busy doing my homework.P.S. Of course, if you decide to use my idea you will need to pay me a commission. I'm thinking 60/40 is fair. P.P.S. Don't make me sue you when I get out.

Since we are on Eastern Time, we had to leave for worship at halftime... and it wasn't looking too good. But a 10 point win to go 10-0 looks just fine. Sometimes you have to take it any way it comes.

A sample of my Criminal Law reading for tomorrow.

On 23 March, 1994, the medical examiner viewed the body of Ronald Opus and concluded that he died from a shotgun wound of the head. The decedent had jumped from the top of a ten-story building intending to commit suicide (he left a note indicating his despondency). As he fell pas the ninth floor, his life was interrupted by a shotgun blast through a window, which killed him instantly. Neither the shooter not the decedent was aware that a safety net had been erected at the eighth floor level to protect some window washers and that Opus would not have been able to complete his suicide anyway because of this. ... The room on the ninth floor whence the shotgun blast emanated was occupied by an elderly man and his wife. They were arguing and he was threatening her with the shotgun. He was so upset that, when he pulled the trigger, he completely missed his wife and the pellets went through the window striking Opus. ... When confronted with this charge, the old man was adamant that...

Q: What's black and brown and looks great on a lawyer?A: A doberman!------A doctor, an engineer, and a lawyer were arguing over which profession was the oldest. The doctor pointed out that on the sixth day God formed Eve out of Adam's rib. Since this amounted to a surgery, the practice of medicine was obviously the oldest. The engineer said, "Yeah, well, on the first day, God created the universe out of darkness, chaos, and confusion. This was the most monumental engineering task ever performed. Thus, engineering is the oldest profession."Finally the lawyer spoke up: "Who do you think created the darkness, chaos, and confusion?"

But this made me smile:Some of you may remember the song "Barbie Girl". It caused a lawsuit. On appeal, judge Kozinski of the 9th Circuit concluded his opinion:After Mattel filed suit, Mattel and MCA employees traded barbs in the press. When an MCA spokeswoman noted that each album included a disclaimer saying that Barbie Girl was a “social commentary [that was] not created or approved by the makers of the doll,” a Mattel representative responded by saying, “That's unacceptable.... It's akin to a bank robber handing a note of apology to a teller during a heist. It neither diminishes the severity of the crime, nor does it make it legal.” He later characterized the song as a “theft” of “another company's property.”MCA filed a counterclaim for defamation based on the Mattel representative's use of the words “bank robber,” “heist,” “crime” and “theft.” But all of these are variants of the invective most often hurled at accused infringers, n...
